GENERAL CONDITIONS

Welcome to our general terms and conditions. Our terms and conditions are presented in two distinct parts, the general terms and conditions of sale and the general terms and conditions of rental. In the event of purchase or rental, when accepting an offer or paying for an order, you automatically accept these conditions.  

GENERAL TERMS OF SALE

1 – The client

The customer acknowledges and guarantees that he/she is a natural person of at least 18 years of age, with full legal capacity to contract and place orders on the company's website. CARTIER PARTY.

When creating an account and registering personal data in the "My Account" section, the customer undertakes to provide accurate, complete and up-to-date information. This information includes the customer's surname, first name, postal address, billing address, telephone number and e-mail address. Any omission or inaccuracy in the data provided may result in delays or the impossibility of processing the order.

The customer is solely responsible for the accuracy of the information provided. In the event of an error in the wording of the contact details provided, particularly those of the recipient, the company CARTIER PARTY cannot be held responsible for any consequences, in particular the impossibility of delivering the products ordered or the additional costs associated with a new shipment.

In addition, the CARTIER PARTY reserves the right to cancel or refuse any order in the following cases:

  • If the IP address used to place the order is domiciled in a country other than the billing and/or delivery address entered by the customer;
  • If there is any doubt about the customer's identity or legal capacity ;
  • In case of suspected fraud or misuse of site services.

In such cases, the company will inform the customer by any appropriate means and, where appropriate, refund any sums already paid. However, the costs incurred in connection with the transaction may be retained if further investigations prove necessary.

The customer also acknowledges that use of the website and validation of an order imply full acceptance of these terms and conditions of sale, available at any time on the site.

2 – The products

The products offered for sale by CARTIER PARTY are those presented and described on the website. Particular care is taken in their presentation and description in order to provide the customer with the most accurate and detailed information possible. However, minor or non-substantial errors may occasionally occur in the descriptions, which the customer acknowledges and accepts.

In the event of non-conformity between the product delivered and its description on the site, the customer has the following remedies:

  • Exercising your right of withdrawal in accordance with applicable legal provisions.
  • Asserting the guarantee of conformity with the company CARTIER PARTYwhich may proceed, as the case may be, with :
    • Product exchange.
    • A full or partial refund of the invoiced amount, depending on the circumstances.

The company CARTIER PARTY would also like to remind you of the specific characteristics of reusable products. Reusable products are not guaranteed to last, as their lifespan is closely linked to ..:

  1. Customer use.
  2. The precautions taken when cleaning and transporting them.

As a result, reusable products cannot be guaranteed or exchanged after initial use..

3 – The order

The placing of an order on the company's website CARTIER PARTY is subject to a specific procedure. This consists of a series of steps that the customer must follow to validate the order.

Before the final validation, the customer has the possibility of :

  1. Check the details of your order (including the list of selected products and their total price).
  2. Correct any errors.

Confirmation of the order by the customer implies acceptance of these terms and conditions and the formation of a sales contract.

Company rights CARTIER PARTY

The company CARTIER PARTY reserves the right to refuse an order for legitimate reasons, in particular in the following cases:

  • Supply difficulties of the products ordered.
  • Geographical area not served by the delivery service provider.
  • Problem with the order receivedFor example, a misunderstanding or inaccuracy in the information provided.
  • Abnormally high order quantities not corresponding to the usual needs of a consumer.

If an order is refused, the company will inform the customer by e-mail. In addition, CARTIER PARTY also reserves the right not to proceed with an order in the following cases:

  • Unresolved dispute or incident concerning the payment of a previous order.
  • Orders or conduct contrary to the provisions of these terms and conditions.
Order confirmation and communication

Once the order has been validated, the company CARTIER PARTY will send the customer a summary confirmation email. This email will contain :

  • List of products ordered.
  • Total price.
  • Product availability.
  • Selected quantity.

The customer formally accepts the use of email as a means of communication to receive order confirmation.

Invoices relating to orders can be accessed at any time via the customer's order history.

4 - Prices and payment terms
Product prices

The prices of products offered by the company CARTIER PARTY are as follows:

  • For Switzerland Prices are in Swiss francs (CHF) and include all applicable taxes (VAT). Shipping costs are not included in the displayed price and will be added to the total amount of the order. The total price, including taxes and shipping costs, is clearly indicated in the basket summary before the order is validated.
  • For other countries The prices shown are exclusive of VAT. Consequently, no VAT deduction can be applied.

By placing an order for delivery in a country other than Switzerland, the customer acknowledges :

  1. That it is considered the official importer products.
  2. That, depending on the legislation in force in the chosen country of delivery, it may be subject to customs duties and/or import taxes. Any such costs are the sole responsibility of the customer and must be paid directly to the competent authorities or the carrier upon delivery.
Rate changes

The company CARTIER PARTY reserves the right to modify its prices at any time and without notice. However, the products ordered will be invoiced at the rate in force at the time the order is registered, subject to availability of the said products.

5 – Delivery
Delivery address

The products ordered are delivered to the address indicated by the customer when placing the order. This address must correspond to :

  • At the customer's residence, or
  • To the address of any other natural person designated by the customer.

Important Deliveries cannot be made to hotels or P.O. boxes.

Accuracy of Information Provided

To guarantee delivery under the best possible conditions, the customer must provide accurate and complete information concerning the delivery address. This includes, among others :

  • Street number.
  • Building and/or staircase number.
  • Access codes.
  • Intercom names or numbers.

In the event of errors or incomplete information provided by the customer, the company CARTIER PARTY cannot be held responsible for late or failed deliveries.

Delivery times

The delivery times indicated on the site or at the time of ordering are given purely as an indication. They correspond to average processing and delivery times. Although the company CARTIER PARTY makes every effort to meet these deadlines, it cannot be held responsible for the consequences of a delay in delivery beyond its control (for example, a delay attributable to the carrier).

Parcel receipt and complaints

Upon receipt of the parcel, the customer must check the condition of the products delivered. In the event of a damaged parcel (for example, one that has already been opened or missing products), the customer undertakes to :

  1. Notify the carrier immediately specifying any necessary reservations (e.g. refusal of parcel or damage report).
  2. Inform the company FÊTE DE CARTIER of the situation, within 2 days of receipt of the parcel, using one of the available contact methods:
    • Email.
    • Phone number.
    • Postal mail.

These reservations are essential to enable the company to deal effectively with the complaint and, where appropriate, to proceed with an exchange or refund in accordance with the terms and conditions laid down.

6 – Right of withdrawal
6.1 - No legal right of withdrawal

In accordance with Swiss law, no legal provision imposes a withdrawal period or a right of return for purchases made online. Consequently, unless otherwise specified in these terms and conditions, all orders placed are considered firm and definitive.

However, the charter of ethics of theAssociation of Commerce.Swiss provides for a fourteen (14) day right of return, but this provision applies only to members of the said association.

6.2 - Right of withdrawal granted by FÊTE DE CARTIER

Although not required by law, CARTIER PARTY offers the customer a right of withdrawal under certain conditions. The customer may exercise this right within a period of fourteen (14) calendar days from the date of receipt of the products.

For the return to be accepted, the following conditions must be met:

  • Products must be new, unused, unworn, unwashedand in their original packaging intact.
  • All returns must be accompanied by order number and proof of purchase.
  • Return shipping costs are exclusively at the customer's expense.

6.3 - Repayment terms

After receipt and verification of the condition of the returned products, CARTIER PARTY will refund the sums paid by the Customer, excluding initial shipping costswithin fourteen (14) days following receipt of the returned items.

The refund will be made according to the method of payment used at the time of purchase, unless expressly requested by the Customer and validated by the Company.

In the event of non-compliance with the above-mentioned return conditions, CARTIER PARTY reserves the right to refuse reimbursement.

7 - Refunds

Product refunds, in the cases provided for in articles II and VI of these terms and conditions of sale, will be carried out by the company Cartier Festival within a maximum period of thirty (30) days upon receipt of the returned products.

Reimbursement will be made by the same method of payment used by the Customer at the time of ordering, unless otherwise agreed between the parties. Cartier Festival may also offer, if the Customer accepts it, a refund in the form of gift certificate valid on a future order.

In the event of non-compliance with the return conditions defined in article VI, Cartier Festival reserves the right to refuse reimbursement or to apply a discount depending on the condition of the returned products.

8 - Intellectual property

The Swiss Aperitif Federationoperated by Cartier Festivaland all its contents (text, images, videos, product descriptions, graphics, etc.) are protected by copyright laws. intellectual property.

As such :

  • Any reproduction, modification, distribution or use, even partial, of the Site and its content is strictly prohibited. strictly prohibited without authorization expressly and in writing from Cartier Festival.
  • The Site and its elements may not be copied, sold or exploited for commercial purposes without prior agreement.
  • All rights to the trademarks, logos, trade names and other distinctive elements appearing on the Site remain the exclusive property of Cartier Festival.

The Customer undertakes to respect these rights and shall refrain from any unauthorized use of protected content, on pain of prosecution.

9 - Responsibility

The company FÊTE DE CARTIER disclaims any responsibility in the event of material damage or bodily injury resulting in superficial, serious injuries or death due to personal modifications of the product, negligence, or handling and use outside of the intended purpose of our products by the customer. The company FÊTE DE CARTIER reminds that the marketed products are not suitable for children under 12 years old. The company FÊTE DE CARTIER is not responsible for actions taken by the customer while using the products sold on the website www.fsda.ch and reminds that alcohol abuse is dangerous to health.

GENERAL RENTAL TERMS AND CONDITIONS

1 – Offer

You can request a quote directly by phone, instant messaging, or from our website by providing all the required information. We are also reachable by phone at 078 206 13 20 or by email at contact@fsda.ch. We will respond to your request as soon as possible, usually within 24 hours. The quote does not guarantee the availability of the equipment. It must be checked at the time of the final order.

2 – Order

All final orders must be placed in writing or by return email. Subject to the availability of the material at the time of receipt of your confirmation. It is upon this confirmation that the customer accepts the rental conditions.

3 – Rates

4 – Property, liability, and insurance

The rented equipment remains the entire property of Fête de Cartier. The tenant is prohibited from allowing it to be seized by one of its creditors.

The responsibility and the physical and legal custody of the equipment are transferred when it is made available, from the moment it leaves the depot provided by Fête de Cartier until its return, respectively, until the return to the depot if the client collects the equipment themselves. The ordering client assumes this custody under their full and sole responsibility in the event of theft, deterioration, vandalism, fire, water damage, etc. They will take out, at their own expense, an insurance contract to cover their liability during the time they are in custody of the installations and equipment.

The ordering client must in particular take care of obtaining all the necessary authorizations for the ordered services, ensure that the locations are available and accessible without any difficulty, and obtain any possible extensions of guarantees from their insurers.

5 – Provision and return of equipment

The ordering client must be present during the delivery and return of the rented equipment. He acknowledges receiving the equipment in good condition, suitable for operation, and in compliance with current safety standards. The ordering client agrees to return the rented equipment, packaged in its original protections, bins, bags, plastics, and trolleys. The equipment will not be considered returned until it has been inventoried upon its return to our depot. Throughout the duration of the rental, the ordering client is required to ensure the maintenance of the rented equipment and to protect it against any damage, vandalism, overload, bad weather, theft, etc. The ordering client is not entitled to any compensation in case of interruption of operation of the rented equipment.

6 – Total or partial cancellation

A penalty of 20% is planned in case of cancellation of a confirmed order, regardless of when the event takes place. When the invoice is paid. Cases of flexibility may be exceptionally granted by our company in very particular cases. A penalty of 40% is planned in case of cancellation of the order within 7 days following the event. And finally, on the day of the event, 100% of the amount will be charged.

7 – Transport

The rate will be applied for all deliveries and returns according to our current scale.

Transport by our care :

The rate is defined by a base of 20 CHF per trip (including 20 km from the depot) to which an additional 1 CHF per km traveled beyond that is added. For any transport offer, Fête de Cartier can adjust the calculation based on volume, weight, and the necessary vehicle (utility, with or without trailer, simple car, etc.). The rate obtained during one of our services may change and is not necessarily used as a reference for a future request. Only the new offer provided is binding. Basic transport refers to delivery to the door. For deliveries to upper floors or with particular difficulties, please let us know; the rate will be adjusted to the client's needs.

Your own transport :

No charges will be billed to you; however, the client is responsible for using a vehicle suitable for the equipment being transported. In the event of a transportation request outside of opening hours, during the night, on weekends, on public holidays, or specifying a precise delivery or return time, additional charges may apply.

8 – Special conditions for the rental of textile, tarpaulin, etc...

The rental of textiles, for example table covers, is very closely monitored. Indeed, if a cover is stained and therefore irrecoverable, it will be charged to the customer. That is why we reserve the right to charge the customer for the stained cover(s) according to the supplier's selling price. This is also the case for any damage to textiles or tarpaulins, and this within a period of up to 10 days after the return of the equipment if the customer has not informed our services of the damage.

The rental conditions can be modified at any time by our company.
